    Dear All,

    These guys have stole my Nerd Boy. They use him in a commercial =
    even.

    I have had the various domains and the Nerd Boy since 1997 and 1998. =
    So now I have to call my lawyer I guess. They have only had their =
    domain since 2001. This could get interesting and expensive. I paid a =
    lot to have him made in the first place.

    They are in the DC area and I spoke there for Verio at a conference =
    as a Keynote Speaker and had a about 10 or 12 Nerd Boys that I used for =
    one of my presentations. I wonder if they got the idea then.

      Did you ask them about it? Have they been reasonable? Do you have
      "nerdboy" trademarked? You would be able to win any court battle- you
      have all of us as witnesses as to how long you've been in business :)

        Here's a thought that seems to be in the minority though:

        Any way you can ask them to kindly remove all references to your
        company/logo/etc first before suing them for everything? I only ask this
        because it could be people's livelihoods at stake over albeit a stupid
        mistake but one that could be quickly corrected?

          OT: Stolen Logo



          Dear Scot,

          I have been trying to get Nerd Boy as a Trademark, but they say it is "A
          Generic Term" and cannot be Trademarked. Funny, Microsoft was able the
          Trademark "Windows" which I think is pretty generic. I am not done with
          this whole process yet. With no problems at all it can take 2 to 3 years to
          get a Trade Mark.

          I am thinking the Logo will be covered under Copyright Law, but I am not
          absolutely sure about that...hence the call to my attorney.
