    NY trying to tax online sales

    Claiming affiliates constitute "physical presence". Interesting to see where this all leads.

      Supreme Court has already ruled on this. They can't enforce it because Federal Law trumps State Law on this matter.

        Yes the Quill precedent does require physical presence in order for you to be required to collect taxes on behalf of a state.

        NY is trying to challenge what physical presence means in order to get around this and collect the tax.

          We have a client who sells online in NY and they must report tax for each township and they are almost all different by as little as a 1/4 of a percent. We decided to use the Net Blazon Zip Tax Module and it is working very well. It is not perfect but it is very close and saves a lot of time.

            Just FYI, we've created a new product service called TaxTools that we sell as a Software as a Service offering at AccurateTax.com. This new service calculates sales tax rates based on zip+4 boundaries...much more accurate than the regular 5-digit zipcodes.
